Financial-Lee Advisory, LLC (“Financial-Lee,” “we,” “us,” or “our”) respects the privacy of its clients and prospective clients. Because providing investment advisory services, including integrated financial planning, requires us to receive personal and financial information, protecting that information is an important part of our fiduciary and compliance responsibilities.
This notice describes the categories of nonpublic personal information we may collect, how we use and disclose that information, and the measures we use to protect it. The notice applies to current and former individual clients and, where applicable, to individuals who seek advisory services from Financial-Lee.
1. Information We Collect
We collect information that is reasonably necessary to evaluate your financial circumstances, establish and service the advisory relationship, manage your investments, provide financial planning and education, communicate with you, maintain required records, and satisfy legal and regulatory obligations.
We may collect information directly from you in person, by telephone, email or text message, through forms and documents you provide, and through the Financial-Lee website. The website contact form may collect your name, email address, and the content of your message. We may also receive information from custodians, financial institutions, professionals, service providers, and other sources as permitted by law.
Depending on the services you request and the accounts involved, this information may include:
- identifying and contact information, such as your name, address, telephone number, email address, date of birth, Social Security or taxpayer identification number, and similar information;
- financial information, such as income, net worth, assets, liabilities, tax information, liquidity needs, investment objectives, risk tolerance, time horizon, and financial goals;
- account and transaction information, including account numbers, holdings, balances, contributions, withdrawals, purchases, sales, and other activity;
- family, beneficiary, estate-planning, employment, retirement, insurance, and other information relevant to the advisory or financial-planning services you request; and
- information received from you, your qualified custodian, other financial institutions, professionals or service providers you authorize, and other sources as permitted by law.
2. How We Use Your Information
Financial-Lee uses nonpublic personal information for legitimate advisory, operational, compliance, and legal purposes. These purposes may include:
- providing investment management, financial planning, financial education, and related client service;
- opening, maintaining, administering, and reviewing advisory accounts;
- communicating and coordinating with you and, when authorized or otherwise permitted by law, with your custodian or other professionals and service providers;
- calculating and collecting advisory fees;
- maintaining books and records, performing compliance reviews, protecting against fraud or unauthorized activity, and responding to legal or regulatory requirements; and
- operating and protecting Financial-Lee's business, systems, records, and communications.
3. Information We Share
Financial-Lee does not sell your nonpublic personal information. We do not disclose your nonpublic personal information to nonaffiliated third parties so that they can market their products or services to you.
We may disclose nonpublic personal information when reasonably necessary to provide or administer the services you have requested or as otherwise permitted or required by law. Depending on the circumstances, recipients may include:
- qualified custodians, brokers, banks, and other financial institutions involved in servicing your accounts or processing transactions;
- technology, recordkeeping, communications, data-security, document-management, and other service providers that support Financial-Lee's operations;
- attorneys, accountants, auditors, insurance providers, consultants, or other professional advisers assisting Financial-Lee or, when authorized by you, assisting with your financial affairs;
- government agencies, regulators, law-enforcement authorities, courts, or other persons when disclosure is required or permitted by law; and
- other persons or entities when you request or authorize the disclosure.
Financial-Lee does not currently have affiliated companies with which it shares client nonpublic personal information for marketing purposes. If our information-sharing practices materially change, we will revise our notice and provide any notice or choice required by applicable law.
4. Your Right to Limit Sharing
Because Financial-Lee does not share nonpublic personal information with nonaffiliated third parties for their independent marketing purposes, our current practices do not create a general opt-out right under the federal financial privacy rules. The disclosures described above are limited to servicing and administering the advisory relationship, disclosures you authorize, and other disclosures permitted or required by law.
If Financial-Lee changes its practices in a manner that gives you a legal right to limit particular information sharing, we will provide the required notice and a reasonable method for exercising that right before the affected disclosure occurs.
5. How We Protect Your Information
Financial-Lee maintains administrative, technical, and physical safeguards designed to protect the confidentiality, security, and integrity of nonpublic personal information. Our safeguards are designed to reduce the risk of unauthorized access, use, alteration, loss, or disclosure.
These safeguards include limiting access to information to persons and service providers with a legitimate business or legal need, using reasonable security measures for electronic systems and communications, protecting paper and electronic records, evaluating relevant service-provider safeguards, and securely disposing of records when retention is no longer required.
No security system can eliminate every risk. Financial-Lee therefore reviews its safeguards and information-security practices and updates them when reasonably necessary in light of its operations, technology, service providers, and applicable requirements.
6. Former Clients
Financial-Lee applies its privacy protections to nonpublic personal information about former clients as well as current clients. We may retain former-client information for the periods required by law, regulation, contractual obligations, legitimate business needs, or our books-and-records policies. During that period, the information remains subject to applicable confidentiality and security protections.
7. Service Providers
Financial-Lee may use third-party service providers to support custody, account administration, technology, communications, recordkeeping, cybersecurity, professional services, and other business functions. When a service provider receives nonpublic personal information, Financial-Lee seeks to use providers whose services and safeguards are appropriate to the nature of the information and the services being performed.
Financial-Lee's use of a service provider does not authorize that provider to use client information for unrelated purposes except as permitted by law or by an applicable agreement.
8. Protecting Your Own Information
You can also help protect your information. Please use reasonable care when transmitting sensitive information, safeguard passwords and account credentials, review communications and custodial statements, and promptly notify Financial-Lee and the applicable custodian if you suspect unauthorized activity or believe information we maintain about you should be updated.
9. Website and Text Messaging
Financial-Lee may use its website to provide general information about the Firm and to allow visitors to contact us. Information submitted through the website is used to respond to inquiries, communicate with prospective or current clients, maintain appropriate business records, and for other legitimate operational, compliance, or legal purposes described in this notice.
Financial-Lee may communicate by text message with clients and prospective clients who have consented to receive text communications. Text messages are used for general customer-care and administrative communications, including responding to inquiries, answering questions, providing support, scheduling or confirming meetings, and other communications related to the advisory relationship or requested services.
Consent to receive text messages is not a condition of obtaining advisory services. Messages will be sent from Financial-Lee's business telephone number, (954) 686-6768. Message frequency will vary based on communication needs. Message and data rates may apply.
You may cancel SMS communications at any time by replying STOP to the telephone number from which you received the message. Financial-Lee will send an SMS message confirming that you have been unsubscribed. After that confirmation, you will no longer receive SMS messages from us unless you subsequently opt in again. Wireless carriers are not liable for delayed or undelivered messages. If you have questions concerning your text or data plan, please contact your wireless provider.
Financial-Lee does not share customer information with third parties for promotional or marketing purposes. Mobile telephone numbers, mobile opt-in information, and SMS consent information are not shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in and consent information is not shared with third parties for purposes unrelated to providing the messaging service.
10. Changes to This Notice
Financial-Lee may revise this Privacy Notice when its privacy practices, services, legal obligations, or regulatory requirements change. We will provide a revised notice when required by applicable law.
Financial-Lee will provide an initial privacy notice to clients as required when the client relationship is established. Financial-Lee will also provide subsequent privacy notices when required by applicable law. Under current federal law, an annual notice may not be required when Financial-Lee limits its information sharing to specified legal exceptions and has not changed the policies and practices described in its most recent notice.
